Orden de compra obligatoria

Hace años, durante el Tigre Celta, planeé comprar algunos terrenos agrícolas, pero no lo hice porque el precio de la tierra en ese momento era excesivo. Creo que ahora los precios están en un nivel razonable y me gustaría invertir. Me gustaría que me asesoraran sobre los posibles impuestos que tendría que pagar. Tengo entendido que tendré que pagar el impuesto sobre actos jurídicos documentados. ¿Hay algún otro impuesto que deba tener en cuenta, por ejemplo, el impuesto sobre la plusvalía o el impuesto sobre las adquisiciones de capital?

El tipo del impuesto sobre actos jurídicos documentados aplicable a los terrenos agrícolas o a las propiedades comerciales ha aumentado en los últimos años. Si adquiere un terreno agrícola u otra propiedad comercial, actualmente se aplica un impuesto sobre el timbre del 6% del valor del terreno. Por ejemplo, si adquiere un terreno por 150.000 euros, deberá pagar un impuesto de timbre de 9.000 euros. Si el impuesto sobre actos jurídicos documentados no se paga en el plazo establecido, también habrá que pagar intereses y sanciones.

El impuesto sobre las plusvalías (CGT) es un impuesto que se paga sobre los beneficios obtenidos por la enajenación de una inversión inmobiliaria, es decir, por la venta de cualquier propiedad que no sea su residencia principal. El tipo del impuesto sobre las ganancias de capital es actualmente del 33%. Este impuesto no afecta al comprador de la propiedad. Sólo afecta al vendedor.

El Impuesto sobre Adquisiciones de Capital (CAT) sólo se paga al recibir una donación o una herencia. En el caso de que usted adquiera un terreno por su valor de mercado, no tendrá que pagar el Impuesto sobre Adquisiciones de Capital. Sin embargo, si el terreno u otra propiedad se transfiere de una parte a otra por un valor sustancialmente inferior al de mercado, la Hacienda Pública puede considerar esta transacción como un regalo, y el CAT puede ser exigible. Por ejemplo, si usted compra un terreno a un familiar por 50.000 euros y el valor de mercado conocido de la propiedad es de 150.000 euros, Hacienda considerará que esta transacción contiene un regalo de un familiar a otro de 100.000 euros. El tipo del CAT es actualmente del 33%.
