WHAT IS A FATAL INJURY CLAIM: A fatal injury claim arises when sadly the death of a loved one is caused by the wrongful act of another. The legal action can be taken by the next of kin of the deceased. Obviously, no amount of money can compensate for the loss of a loved family member, the compensation awarded will simply help with future costs for you and your family.

WHEN DOES A FATAL INJURY CLAIM ARISE: A fatal injury case can arise following a wrongful death to include such scenarios as an accident at work, a road traffic accident, medical negligence, assault and indeed any situation where your loved one’s death was caused by the wrongful act of another.

WHO CAN BRING CASE? A fatal injury claims may be brought by one nominated party on behalf of all of the parties entitled to bring a claim. All parties entitled to bring a claim will include the deceased’s own family, spouse, partner, and children. In some cases, the next of kin definition extends to civil partner, grandparents, parents, brothers, sisters, and stepchildren.

IS THERE A TIME LIMIT TO BRING A CLAIM? Yes, legal proceedings must be iniatiated within two years from the date of death.

WHAT DOES COMPENSATION FOR A FATAL INJURY CLAIM COVER? A fatal injury claim will include compensation for all losses incurred following the death of a loved one including:

Financial loss/loss of earnings into future:This may be claimed by any dependent (e.g. spouse, partner, children) who was financially dependent on the deceased at the time of death. The expected earnings of the deceased over their lifetime will be calculated in conjunction with our expert Actuarial advisors.

Childcare: if the deceased was caring for his/her children at the time of death then this future childcare cost will also be calculated in conjunction with our expert Actuarial advisors.

Loss of services: This sum will cover costs of any additional services provided by the deceased e.g. gardening, home repairs.

Solatium fee: This is a set sum of €35,000 offered by way of consolation to be shared among the next of kin.

Funeral and related expenses will also be claimed.
