Psychiatric Injuries
Psychiatric Injuries or nervous shock type injuries are injuries that are suffered and they result in a disorder of the mind. Examples of such injuries include adjustment disorder, post-traumatic stress disorder or clinical depression.
In Ireland, if it can be established that the defendant was negligent and this negligence resulted in a foreseeable psychiatric disorder, then the plaintiff is entitled to damages.
The most common cases of psychiatric injuries arise where the Plaintiff has witnessed the death of a loved one which has come about due to the negligence of medical staff. It is quite often the case that the death was extremely distressing in the manner that it happened.
To be adequately compensated for the death of a loved one, the Plaintiff should be diagnosed to be suffering from a recognised condition by a Consultant Psychiatrist.
